Policies

1. Scope and Application

These terms apply to all quotations, orders, sales, shipments, and services provided by KD DEPOT. Any additional or conflicting terms proposed by Customer are expressly rejected unless agreed to in writing by KD DEPOT.

2. Orders, Pricing, and Acceptance

All orders are subject to acceptance by KD DEPOT. Prices, product availability, and specifications are subject to change without notice. Errors in pricing or product descriptions do not obligate KD DEPOT to fulfill an order.

KD DEPOT reserves the right to refuse service, cancel orders, or limit quantities at its discretion.

3. Payment Terms

Payment is due at the time of order unless Customer has been approved for credit.

Approved credit accounts are due net thirty (30) days from the shipment date unless otherwise stated. Past-due balances may accrue interest at the maximum rate permitted by law. KD DEPOT may suspend shipments, revoke credit privileges, or require prepayment for delinquent accounts.

4. Taxes

Customer is responsible for all applicable sales, use, excise, or similar taxes arising from the transaction, excluding taxes based on KD DEPOT's income.

5. Shipping and Delivery

Shipping charges are added to the invoice unless otherwise stated. Delivery dates are estimates only and not guaranteed.

Title and risk of loss transfer to Customer upon delivery of goods to the carrier. KD DEPOT is not responsible for delays, damage, or loss caused by the carrier.

6. Returns

All returns require prior authorization from KD DEPOT and must comply with the Return Policy in effect at the time of purchase. Unauthorized returns will be refused.

7. Limited Warranty

KD DEPOT warrants that products will conform to the manufacturer's specifications at the time of shipment. KD DEPOT's sole obligation is limited, at its option, to repair, replacement, or refund at the purchase price.

8. Disclaimer of Warranties

EXCEPT AS EXPRESSLY STATED, KD DEPOT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

9. Limitation of Liability

KD DEPOT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. KD DEPOT'S TOTAL LIABILITY SHALL NOT EXCEED THE PURCHASE PRICE OF THE PRODUCT GIVING RISE TO THE CLAIM.

10. Product Use and Compliance

Customer is responsible for determining the suitability of products for their intended use and for compliance with all applicable laws, codes, regulations, and safety requirements.

11. Intellectual Property

All content on the Site, including text, graphics, logos, and images, is owned by KD DEPOT or its licensors and is protected by intellectual property laws. Unauthorized use is prohibited.

12. Indemnification

Customer agrees to indemnify and hold harmless KD DEPOT from any claims, damages, losses, or expenses arising from Customer's use of the Site or products or violation of these terms.

13. Governing Law and Venue

These terms are governed by the laws of the State of California, without regard to conflict of law principles. Venue shall be exclusively in state or federal courts located in Orange County, California.

14. Entire Agreement

These terms constitute the entire agreement between KD DEPOT and Customer regarding the subject matter herein and supersede all prior agreements or understandings.

Information Collected

We may collect business and personal information including name, company name, billing and shipping address, email address, phone number, and payment information.

Use of Information

Information is used to:

• Process orders and payments
• Manage customer accounts
• Provide customer support
• Improve website functionality
• Comply with legal obligations

Information Sharing

KD DEPOT does not sell personal information. Information may be shared with service providers, carriers, payment processors, and legal authorities as required to conduct business or comply with law.

Data Security

We use commercially reasonable safeguards to protect information but cannot guarantee absolute security.

Cookies

The Site uses cookies and similar technologies to enhance user experience and site performance.

Third-Party Links

KD DEPOT is not responsible for the privacy practices of third-party websites linked from the Site.

Policy Changes

KD DEPOT may update this Privacy Policy at any time. Continued use of the Site constitutes acceptance of changes.

Return Authorization

All returns require prior authorization. Returns without authorization will be refused.

Return Eligibility

Eligible items may be returned within fourteen (14) days of delivery. Products must be unused, in original packaging, and in resalable condition.

Non-Returnable Items

The following items are non-returnable:

• Special-order or custom products
• Clearance or discontinued items
• Installed electrical products
• Hazardous materials

Restocking Fees

Approved returns may be subject to a restocking fee of up to twenty-five percent (25%).

Freight Charges

Original and return freight charges are non-refundable unless the return is due to KD DEPOT error.

Damaged or Incorrect Shipments

Claims for damaged or incorrect items must be reported within five (5) business days of delivery.

Delivery Estimates

• Next Day Air shipments are estimated for delivery within 1 business day after the order has been shipped.
• 3-Day Shipping refers to 3 business days and does not include weekends or holidays.
• Delivery times provided by carriers are estimates and are not guaranteed unless expressly guaranteed by the carrier.

Shipping Method, Carrier & Delivery Timeframes

We reserve the right to select, change, or substitute the shipping carrier, shipping service, shipping method, and fulfillment location used to process and deliver any order at our sole discretion. This may include upgrading or changing the carrier or service level based on availability, delivery location, package size, operational requirements, weather conditions, or other circumstances beyond our control.

Shipping and delivery timeframes provided at checkout or elsewhere on our website are estimates only and are not guaranteed. Actual shipment and delivery times may vary due to order volume, carrier delays, holidays, weather, customs processing, or other unforeseen circumstances.

If a customer selects or pays for a specific shipping service, we reserve the right to use an alternative carrier or shipping method that provides a similar or faster level of service when necessary. Such substitutions do not affect the validity of your order and, unless otherwise required by law, do not entitle the customer to a refund of shipping charges.

Limitation of Liability

KD Depot is not liable for shipping carrier delays, weather-related delays, lost or damaged shipments, incorrect shipping information provided by the customer, or other circumstances beyond our control.

Refused, Returned or Redelivered Shipments

If a shipment is returned, refused, requires reshipment, or redelivery due to an incorrect address, failed delivery attempts, refusal of delivery, or any customer-related issue, the customer is responsible for all additional shipping and freight charges.

LTL Freight Charges

For LTL (Less-Than-Truckload) freight shipments, the customer is responsible for any additional charges incurred after shipment, including but not limited to reconsignment fees, redelivery fees, residential delivery charges, liftgate fees, detention charges, limited access fees, and other carrier-assessed charges.

Storage Charges

If storage charges are incurred because the shipment is not accepted, picked up, or scheduled for delivery within the carrier's required timeframe, the customer is solely responsible for all storage fees and any additional related costs.

Earning Points

• Earn 1 KD CASH point for every $1 spent on eligible merchandise.
• Points are calculated on the subtotal after discounts, before taxes and shipping.
• Points are awarded only after payment is successfully processed.
• Bonus points may be offered during promotions at KD DEPOT's discretion.

Pending vs. Available Points

• Points are Pending while the order is being processed.
• Points become Available 30 days after delivery.

Redeeming KD CASH

• 100 KD CASH = $1.00.
• KD CASH may be redeemed on future purchases only.
• Points cannot be redeemed for cash.
• Points cannot be used to purchase gift cards.
• Customers must have a minimum of 500 points ($5) before redeeming.
• Minimum purchase of $25 before redeeming KD CASH.
• Customers may redeem up to 25% of an order total in KD CASH.
• Maximum redemption per order: $100 in rewards.

For example, on a $200 order the maximum redemption is $50, and the customer pays at least $150.

Cancelled Orders

If an order is cancelled by the customer, cancelled due to failed payment, or cancelled by KD DEPOT, then:

• No points will be awarded.
• Any pending points will automatically be removed.
• If points were already credited, they will be deducted from the customer's account.

Returns and Refunds

If products are returned:

• Points earned from the returned items will be removed.
• Partial returns remove only the applicable points.
• Full returns remove all earned points.

For example, a $250 purchase earns 250 points. If $80 worth of merchandise is returned, the balance is reduced from 250 to 170 points.

IF AN ORDER THAT EARNED KD CASH IS REFUNDED, CANCELLED, CHARGED BACK, OR RETURNED AFTER THOSE POINTS HAVE ALREADY BEEN REDEEMED, THE CORRESPONDING POINTS WILL BE DEDUCTED FROM THE CUSTOMER'S KD CASH BALANCE. IF THE ACCOUNT BALANCE BECOMES NEGATIVE, THE NEGATIVE BALANCE MUST BE REPAID THROUGH THE CREDIT CARD ON FILE.

Abuse Prevention

KD DEPOT reserves the right to:

• Cancel fraudulent points.
• Correct accounting errors.
• Close accounts abusing the rewards program.
• Limit or refuse rewards for suspected abuse.

Points expire after 12 months of account inactivity.

What Counts Toward Points?

Eligible:

• Merchandise

Not eligible:

• Sales tax
• Shipping
• Gift cards
• Previous balances

Customers can use coupons and still earn points on the discounted subtotal. For example, on a $100 subtotal with a $20 off coupon, points are earned on $80.
